Farage’s plan to deport 10,000 foreign national offenders to El Salvador or Kosovo sounds simple — until you look at the legal, practical and human rights problems he barely mentions.
UK prisons are near capacity. Foreign national offenders make up around 12% of the population in England and Wales (roughly 10,000–10,100 people). Reform UK says send them all home, or if their countries refuse, rent space in places like El Salvador’s CECOT mega-prison. Let's look at why that idea runs into serious obstacles.
Key problems:
- Around one-third of those foreign nationals are still on remand and not yet convicted
- Long-standing difficulties getting travel documents and cooperation from many home countries
- Documented conditions in El Salvador’s prisons (beatings, overcrowding, deaths in custody, restricted monitoring) that raise clear Article 3 ECHR and non-refoulement risks
- Logistical, cost and post-sentence enforcement gaps for third-country transfers
- Limited overall impact on the wider overcrowding crisis even if the plan worked perfectly
The proposal targets a real pressure point, but the practical and legal frictions that have blocked similar policies for years remain largely unaddressed.
