I don't normally handle criminal defense work, but this was a favor to a friend. The client bought a knife online through Amazon, and was then charged in California with a misdemeanor possession of a switchblade. Today, with the In re Gilbert decision, I had that charge and others all tossed. I will be filing an PC 851.8 petition on the DA to get a determination of factual innocence. The procedure is different - first you go to the court, serve the petition on the DA, then go to the clerk's window to get a hearing date. Remember to always stay vigilant. Question things.
