On April 7, 2024. A Deputy from the Marquette County Sheriff’s Department conducted a traffic stop on a vehicle that did not have their headlights on and was speeding. Upon making contact with the driver (Larry), the officer noticed a strong odor of intoxicants emitting from the vehicle and that Larry’s eyes were bloodshot and glossy. The officer explained the reason for the stop and Larry attempted to turn his lights on multiple times, claiming the headlight switch would not stay on but was due to him constantly switching it back and forth. He also claimed to be having electrical issues. He admitted to not having a valid license but denied drinking any alcohol. Other officers were called for backup and Larry was asked to step out from the vehicle and perform field sobriety tests, which he refused to do. He also refused a PBT and was then secured in handcuffs, searched, and placed into a squad car. The passenger and vehicle were also searched as there was an open container in plain view. While transporting Larry to the hospital for a blood draw, he became verbal, saying that he knew how to escape from the handcuffs and stated “I got a Firearm on me, You Didn't Check”. The Deputy quickly stopped his vehicle, got out and called for backup. Multiple other Deputies arrived and used ballistic shields to provide a level of protection. They approached the squad car, grabbed Larry and took him to the ground. Once Larry was on the ground, a very thorough search was completed and no firearm or any other contraband was located. Larry briefly went unresponsive but responded quickly when deputies said that they would use narcan. EMS was called as the Deputies were unsure if Larry had ingested any sort of drugs that would cause him to potentially overdose or create a serious medical problem. It was determined that there was only one open container in the vehicle and that the passenger did not have anything illegal, so the passenger was free to leave. In the ambulance, Larry became physically uncooperative, thrashing around and not allowing the EMS Staff to adequately check him. Due to Larry being uncooperative, a Deputy applied for a search warrant for his blood and and a transport van with a restraint chair transported him to the Hospital. After the blood draw, Larry was transported to the Marquette County Jail to get booked. Larry received multiple charges including 3 counts of Felony Bail Jumping, Resisting or Obstructing an Officer, Ignition Interlock Device Tampering/Failure to Install/Violate Court Order, and Operating While Revoked but was only found guilty for OWI (5th or 6th). He was sentenced to 18 months in prison and 2 years of extended supervision. His license also got revoked for 36 months and he was ordered to pay $2,747 in fines and fees.
