Hello everyone,
I hope this message finds you well. I wanted to provide an update following the recent hearing on 14 October 2024 regarding the defamation case brought against me by Deep Cycle Systems Pty Ltd (DCS).
The purpose of the hearing was for the Judge to determine whether DCS is an “excluded corporation”, meaning a corporation that is allowed to sue in defamation. It is not an excluded corporation if it has 10 or more employees or is associated to another corporation.
During the hearing, we argued that DCS has not demonstrated sufficient evidence to qualify as an excluded corporation to be eligible to sue for defamation.
Furthermore, we submitted that DCS failed to submit all requested documentation concerning their overseas operations, particularly regarding their alleged co-owned factory in China.
During proceedings, Paul admitted to publishing matters about DCS that were not true, including having said to me that the turnover for his company in one particular year was $20 million.
Both parties have now presented their arguments, and we await the judge's decision. There is no set timeline for when a verdict will be delivered—it could take months. If the Judge finds in my favour, then the case will be at an end. Obviously, we hope for that outcome.
Should the ruling favour DCS, we intend to continue our legal battle by requesting another hearing to address the second criterion necessary for a defamation claim: establishing that DCS suffered serious financial loss directly attributable to my video.
I want to express my heartfelt gratitude to everyone who has donated and supported me thus far. The case remains ongoing and everything is still open until a verdict is reached.
