AfriForum’s legal battle to challenge the constitutionality of the Expropriation Act began this week in the Western Cape High Court in Cape Town. Several applicants and respondents are involved in this case.
AfriForum's legal team focused on the need for Sections 12(3), 12(4), and 19(8) of the Expropriation Act to be scrapped, and for Section 19(2) to be amended due to its unconstitutionality. The organisation’s legal team emphasised that Sections 12(3) and 12(4) – which allow for expropriation without compensation – are in contravention of Section 25 of the Constitution and must therefore be removed from the Act.
