The Constitutional Court is set to determine who has the power to decide the VAT rate.
The Democratic Alliance has asked the court to confirm a Western Cape High Court ruling that found part of the VAT Act unconstitutional.
The disputed provision allows the Finance Minister to announce a VAT increase before Parliament has passed the law.
The High Court ruled that this gives the executive powers that should belong to Parliament.
