Set during the war of eighteen twelve, Brown versus United States considered the circumstances under which the US can seize enemy property.
John Delano of New Bedford, Massachusetts owned the ship, Emulus.
In February eighteen twelve, Delano chartered the ship to British merchant, Elijah Brown, and his brothers to ship a load of pine timber to Plymouth, England. The Emulus sailed from Charleston to Savannah to pick up the cargo. An embargo was announced on April fourth. The Browns and the master of the ship agreed to sail the ship to New Bedford where the cargo was unloaded.
The timber was stored in a Massachusetts Creek with its ends on the mud.
The United States declared war on the United Kingdom on June eighteenth.
The following April, a US attorney filed a libel, meaning a claim against the cargo in the District Court of Massachusetts on behalf of the United States and Delano.
Elijah's brother, Armitz Brown, claimed that the property belonged to him.
The district court dismissed the libel. The circuit court of Massachusetts reversed and condemned the pine timber as enemy property forfeited to the United States. The United States Supreme Court granted cert.
