In a state of Martin Luther King Junior versus CBS, the eleventh circuit grappled with thorny copyright issues surrounding doctor King's I Have a Dream speech.
Doctor King delivered his stirring speech to over two hundred thousand people in August of nineteen sixty three. The speech was broadcast live on radio and television to millions. One month later, doctor King applied to register a federal copyright in the speech and received a certificate of registration.
In nineteen ninety four, CBS produced an episode of a documentary series containing extensive video of the speech. CBS used the speech without permission from doctor King's estate and refused to pay royalties.
Doctor King's estate sued CBS for copyright infringement. The federal district court granted summary judgment to CBS because doctor King had dedicated the speech to the public domain by general publication. The estate appealed to the eleventh circuit.
