b. Death sentence of four Georgia death row inmates left intact by U.S. Supreme Court (The landmark 1972 Supreme Court case Furman v. Georgia decided that "The arbitrary and inconsistent imposition of the death penalty violates the Eighth and Fourteenth Amendments, and constitutes cruel and unusual punishment." At that time no prisoners had been executed in the U.S. since 1968 with overall public support for capital punishment on the decline. This decision called the constitutionality of the death penalty into question beginning a brief moratorium for all executions nationwide and caused Florida and Texas to rewrite their laws to institute a bifurcated trial system that separated the guilt and sentencing phases to ensure constitutional due process. In 1976 the Supreme Court ruled in Gregg v. Georgia that the death penalty was indeed constitutional when imposed under this system, ending the moratorium. Georgia would not resume carrying out executions of death row inmates until 1983)
