It was another highly controversial ruling by Melville to allow the video in rebuttal, rather than during direct when Gavin was on the stand. The judge allowed it while advising it wasn't for the "truth of the matter." In fact Gavin's sheriff interview directly contradicted major claims he made on the stand, including attributing a sexual story to Michael Jackson when he had originally said that story came from his grandmother in his sheriff interview. Impartial court commentators at the time observed that Gavin's statements in the video were often at odds with his remarks when on the stand. The defense opted to rest instead of recalling Gavin back to the stand for surrebuttal, which otherwise could have added days onto the trial.

Viner's testimony was also barred from court, despite Judge Melville allowing in many third party witnesses for the prosecution who had court-declared perjury, malice, theft and ~$2M in judgments for failed civil litigation against Michael Jackson. Those witnesses likewise told stories of hearing or seeing incidents that the parties themselves consistently denied ever happened, yet their testimonies were still allowed in open court.

Abdool was a compliment to Ralph Chacon as part of the 1108 "prior bad acts" hearsay witnesses, which the host emphasizes "they've both also taken money from tabloids and both have also lost in court, and lost big against Michael Jackson." Abdool was part of the Neverland 5 lawsuit that resulted in repeat sanctions against the plaintiffs for perjury and an ultimate 7-figure jury verdict in MJ's favor after finding theft and malice had occurred by the plaintiffs. Abdool "getting emotional" during the testimony here is noteworthy because he did the same when testifying in 1996, which MJ's defense believed to be contrived and spontaneous for jury manipulation. Back than Abdool told wild stories about alleged Neverland threats and intimidation even including machine guns (none of those claims were substantiated by any other witnesses, but did have ties to fiction writer Victor Gutierrez).

The family "escaped" Neverland and voluntarily returned at least three times during this alleged false imprisonment period, which also predated any other alleged crimes (after Tom Sneddon amended the timeline to compensate for exculpatory evidence).

Jordan Chandler was approached by the FBI in 2004 and again by prosecutors in 2005 and he refused to testify or be involved and indicated he would legally fight any request to do so. Evan Chandler was also never raised as a subject in court, but in 2005 he still owed more than $50,000 to ABC and Diane Sawyer for his failed second $60,000,000 civil suit against 300 defendants. In 2003, Tom Sneddon told Diane Dimond that he wouldn't ever bring any allegations up about Jordan Chandler if Jordan himself did not take the stand to testify, but he did exactly that by calling only third party witnesses relating to those uncharged claims.

Blanca Francia would tell a story of seeing MJ in the shower with Wade Robson, but under oath and repeatedly in 1994, 2005 and 2016 she admitted she didn't see or even hear anything but MJ's shadow that day--and Wade Robson's first visit to Neverland postdated her timeline of when she claimed she saw this incident. These are two witnesses Wade Robson and James Safechuck now rely on for their civil cases.

While Sneddon told the media in 2003 he would only bring 1108 evidence and testimony if Jordan himself took the stand or else it would be unfair hearsay, by 2005 he did the exact opposite. The second month of the 2005 trial saw a series of tabloid-profiting witnesses from 1993-1994 including Adrian McManus, Ralph Chacon, Blanca Francia, Phil LeMarque and others. Each of these witnesses (and at times, their attorneys) profited tens of thousands by selling scandalous stories to the media. Many were part of an unsuccessful wrongful termination lawsuit, which they lost and the jury found several had acted with actual malice and theft. The same familiar names and some others from Hard Copy lore reemerged in 2013-2024 as part of the Wade and James civil litigation.
