India’s debate over religious freedom and school discipline has taken another turn after the Allahabad High Court dismissed a petition by a Class 11 student who had worn a hijab at the same school from Class 6 to Class 10 but was stopped from wearing it in class after entering Class 11. In this video, we break down the August 21, 2026, judgement; why the court held that the petitioner had not provided sufficient material to establish that wearing a hijab is a mandatory religious practice in Islam; and why the school’s uniform policy and institutional autonomy became central to the case. We also examine the Essential Religious Practices test and the constitutional questions around Articles 14, 19(1)(a) and 25.
The video also looks at the wider legal debate surrounding hijab in educational institutions, including the ongoing Karnataka hijab case before the Supreme Court and the difference between government institutions and private schools. Most importantly, we explore the larger question of where the balance should be drawn between religious identity, personal freedom, school discipline and access to education, especially when a student has been allowed to wear hijab for years before facing a restriction.
