The Maharashtra FDA's statewide food safety crackdown under Commissioner Tukaram Mundhe has run into a sharp rebuke from the Bombay High Court.
Gurunanak Dairy and Sweets in Wadgaon Sheri, Pune had its food licence suspended on 12 June 2026, a day after a food poisoning complaint, when inspectors flagged sanitation and hygiene lapses. The shop submitted a compliance report on 9 July. A re-inspection on 13 July found it compliant on 35 of 36 food safety parameters โ a score of 98 per cent. The suspension was still not revoked.
The shop stayed shut for 34 days, losing roughly โน8.5 lakh in revenue on an average daily turnover of about โน25,000. Its appeal before the FDA Commissioner, filed on 15 July, was closed for orders on 11 August without any order being passed.
A bench of Acting Chief Justice Ravindra V. Ghuge and Justice Gautam A. Ankhad set aside the suspension, allowed the shop to reopen, and directed the FDA to pay โน5 lakh in compensation within 30 days. The court held that the department's intention was laudable but that it was going "overboard", described the approach as "strange" and "plain and simple perversity", and dismissed the FDA's pending-appeal defence as a "lame excuse".

The legal question at the heart of this case:
Section 32(1)(d) requires a Designated Officer to give a food business operator a reasonable period โ not less than 14 days โ to comply with an improvement notice before a licence can be suspended. The proviso to Section 32(3) allows immediate suspension only in the interest of public health, for reasons recorded in writing. That is an emergency power. The shop's petition claimed the suspension was passed without any improvement notice and without a hearing. And once re-inspection showed 98 per cent compliance, the emergency that justified the power had ended โ which is precisely why the court called the continued suspension perverse.
