The Supreme Court has dealt President Trump's effort to restrict birthright citizenship a major setback. But Trump isn't giving up, and his latest executive action targets an abuse he has much stronger authority to stop: birth tourism.
In today's show, I explain Trump's new effort to prevent foreign nationals from entering the United States for the purpose of giving birth and obtaining American citizenship for their children. Unlike trying to strip citizenship after a child has already been born here, this approach focuses on controlling who is permitted to enter the country in the first place—an area where I believe the President has very broad constitutional and statutory authority.
But there's a major limitation. Even if Trump eliminated organized birth tourism entirely, I don't believe it solves the much larger birthright-citizenship problem involving children born here to illegal aliens and other temporary residents. I also explain why I believe the Supreme Court misread the 14th Amendment, why United States v. Wong Kim Ark does not answer the precise question presented here, and what realistically would have to happen for the Court's interpretation to change.
