The issue in the Appeal was very narrow: Whether the Crown enjoys absolute immunity from a civil suit seeking Charter damages for the enactment of legislation declared unconstitutional. The AG says it does, and Power, who claims to have suffered damages flowing from unconstitutional legislation, says otherwise.
The Canadian Constitution Foundation has been granted intervenor status in the case to argue that the government does NOT have absolute immunity. In some circumstances, individuals hurt by an unconstitutional law can sue for damages.
