Dear Senator,
As your constituent and a proud member of Gun Owners of America, I urge you to call on Acting Attorney General Todd Blanche to publicly commit that the Department of Justice will not appeal the August 5, 2026 ruling in Silencer Shop Foundation v. ATF.
This ruling correctly held that the National Firearms Act's onerous registration, fingerprinting, and reporting requirements for silencers, short-barreled rifles, short-barreled shotguns, and AOWs are unconstitutional now that Congress eliminated the underlying transfer and making taxes in the One Big Beautiful Bill Act.
The court rightly recognized that this "web of regulation" was only ever justified by Congress's taxing power, and that power vanished the moment the tax was zeroed out, leaving DOJ with no legitimate constitutional basis to keep enforcing burdensome, privacy-invasive paperwork on law-abiding gun owners.
Because you are currently deciding whether to confirm Mr. Blanche to lead the very department responsible for deciding whether to appeal, you have unique leverage right now to insist that he respect this well-reasoned decision and decline to waste taxpayer resources defending an indefensible regulatory scheme, rather than waiting until after his confirmation when that leverage will be gone.
I respectfully ask that you raise this matter directly with Mr. Blanche before he is confirmed and share his response with your constituents, as your leadership on this issue will send a clear message that the federal government must respect both the rule of law and the Second Amendment rights of the people you represent.
