You wondered, and now I'll tell you. These are very difficult briefs to file, and there was only way to get the message to the judge - and that was through the amicus brief. To correctly submit this brief you need to deal with the Ninth Circuit rules, the rules of civil procedure, the rule of appellate procedure and the courts' own local rules. A very daunting task. My motion and brief was procedurally proper and I had an absolute right to file it. They are permissive only, and their getting approved is somewhat low. Yes, she denied the brief, but also true is that she read it. Whether denied or approved, the same message is delivered. Most telling is the judge's statement, which is discussed at the end. I figured Randall Newman would "celebrate" a non-win and then bash me. His ex parte was not ruled upon. The brief is just information for the court to consider. I discuss much more in this video.
