Sweeney v. Schoneberger

A life tenant must balance their use of the property with the rights of any future interest holders. The court in Sweeney versus Schoneberger considered how the doctrine of waste ensures that the future interest holders' rights are preserved.
Charlotte and Adolph Schoneberger held life estates in five properties in Brooklyn.
Elsie Sweeney and several other remainder men were supposed to inherit the properties after the Schonebergers died.
If managed properly, the properties should have generated enough rental income to pay the mortgage interest and taxes and keep the properties in reasonable repair.
However, following Adolph's death, Charlotte stopped paying the mortgage interest and taxes, and the lender eventually foreclosed on three properties.
Sweeney filed suit against Charlotte, alleging that she had committed waste by failing to maintain the properties and not paying the appointment of a receiver to protect the remaining properties.
A New York trial court considered the case.
