CARES Act (30-Day Notice Provision): A federal statutory requirement implemented during the pandemic mandating that landlords of federally backed or assisted properties provide tenants with at least 30 days' advance notice before filing for eviction due to non-payment of rent.
Prorated Rent: A proportional calculation of rent applied to a partial month of tenancy, determined by dividing the monthly rate by the total number of days in the month and multiplying by the active days of occupancy.
Lease Addendum: A separate, legally binding document executed alongside or after an original lease agreement that modifies, updates, or introduces specific terms and conditions (such as housing benefits for active employees).
Default Judgment: A binding judgment entered by a court in favor of a plaintiff when the defendant fails to respond, appear, or defend against the legal action after being properly served.
Alternate Service (Substituted Service): A court-sanctioned method of serving legal process on a defendant when personal service cannot be completed, typically accomplished by securing the documents to the primary entryway of the residence and mailing additional copies.
Writ of Possession: A judicial order directing a law enforcement officer (such as a constable) to evict a tenant and return complete physical control of a real property to the landlord or owner.
Right to Appeal: The legal pathway allowing a party to challenge a trial court’s final ruling by requesting that a higher court review the proceedings for administrative, procedural, or statutory errors, which in eviction matters is subject to a strict statutory filing window (typically five days).
