UCCJEA (Uniform Child Custody Jurisdiction and Enforcement Act): A federal-adjacent uniform state law adopted by US states to establish clear, exclusive jurisdictional rules for child custody disputes, specifically designed to prevent multi-state forum shopping and simultaneous conflicting orders.
Subject Matter Jurisdiction: The constitutional or statutory authority of a court to hear and decide a specific category of cases, which cannot be waived by the agreement of the litigants.
Simultaneous Proceedings: A procedural conflict occurring when identical or closely related legal actions are active in two different state courts concurrently, requiring statutory analysis to determine which court must defer or stay its proceedings.
De Facto Home State: Under the UCCJEA, the state where a child has lived with a parent or a person acting as a parent for at least six consecutive months immediately preceding the commencement of a child custody proceeding.
Registration of a Foreign Judgment: The formal process of registering a certified custody order or decree from an originating state into the court records of a secondary state, allowing the secondary state to enforce or eventually modify the order.
