On January 6, 2021, Rudy spoke at a "Save America March" rally on the Ellipse that was attended by Trump minions protesting the election results. He shouted conspiracy theories that voting machines used in the election were "FUBAR" and called for "trial by combat". Trump minions then stormed the U.S. Capitol in a riot that resulted in the death of five people and disrupted the counting of the Electoral College vote for some time.

Rudy had been calling Republican lawmakers to urge them to delay the electoral vote count in order to throw the election to Trump. Giuliani contacted a Alabama Sen. around 7pm on January 6 to ask him to "try to just slow it down" by objecting to multiple states and "raise issues so that we get ourselves into tomorrow – ideally until the end of tomorrow." However, Giuliani mistakenly left the message on the voicemail of another senator, who leaked the recording. A noted historian termed Rudy's attempts to slow certification in the wake of the riot as treasonous. "Sedition. Open and shut. He talked about the time that was being opened up. He was welcoming, and using, the violence. This needs to be investigated."

Rudy faced criticism for his appearance at the rally and the Capitol riot that followed it. A former Congressman called for the arrest of Rudy, Trump, and Trump Jr. The Manhattan College president stated in a January 7 letter to the college community, "one of the loudest voices fueling the anger, hatred, and violence that spilled out yesterday is a graduate of our College, Rudy Giuliani. His conduct as a leader of the campaign to de-legitimize the election and disenfranchise millions of voters – has been and continues to be a repudiation of the deepest values of his alma mater."

On January 11, the New York State Bar Association announced that it was launching an investigation into whether Rudy should be removed from its membership rolls, noting both Rudy's comments to the Trump minion rally at the Ellipse on January 6, and that it "has received hundreds of complaints about Rudy and his baseless efforts on behalf of Trump to cast doubt on the veracity of the 2020 presidential election and, after the votes were cast, to overturn its legitimate results." Removal from the group's membership rolls would not directly disbar Giuliani from practicing law in New York. The group, Lawyers Defending American Democracy, filed a complaint against Giuliani with the Attorney Grievance Committee of the First Judicial Department of the New York Supreme Court, which has the authority to discipline and disbar licensed New York lawyers.

On January 29, Rudy falsely claimed that The Lincoln Project played a role in the organization of the Capitol riot. In response, FJD announced that the group would be taking legal action against Rudy for defamation.

On June 24, 2021, a New York appellate court suspended Rudy's law license. The panel found that there was "uncontroverted" evidence that Rudy made "demonstrably false and misleading statements to courts, lawmakers and the public" and that "These false statements were made to improperly bolster (Rudy's) narrative that due to widespread voter fraud, victory in the 2020 United States presidential election was stolen from his client." The court concluded that Rudy's conduct "immediately threatens the public interest and warrants interim suspension from the practice of law."
