This video provides an overview of railroad liability. We discuss the sources of railroad liability law (statutory, regulatory, and common law) as well as the applicability of these laws to liability that arises from passenger injuries, third-party injuries, and railroad worker injuries, along with a brief side trip to discuss contractual liability. In addition, we’ll examine strategies that may mitigate or transfer risk. Finally, we’ll review today’s social and economic environment that gives rise to the large (“nuclear”) verdicts that have been appearing more and more frequently in the news.
