Three panelists discussed environmental, real estate and legal worries landowners might have when considering signing an easement with a pipeline company.

Appraiser Joseph Fisher, of the East Stroudsburg firm Fisher and Fisher, told the crowd he’s seen cases to argue both ways that pipelines crush home property values.

There are four new pipeline projects underway, in various planning stages, that essentially will carry gas from north to south.

• Atlantic Sunrise Expansion, a 180-mile project by the Williams.

• Leidy Southeast Expansion, a series of “pipeline loops” totaling about 20 miles by Williams.

• Diamond East Expansion, still in pre-planning stages but expected to include 50 miles of pipeline by Williams.

A Texas-based energy company announced plans in October to construct a $6 billion facility in Newport Township. Creating thousands of jobs, but residents claim their concerns are being ignored. “I’m very concerned about the noise pollution. There’s a whole bunch of questions that we have that need to be answered,” said Laura Keener, Newport Township. Laura keener lives in the Ridge View neighborhood in Newport Township. The proposed natural gas processing facility would be located near the neighborhood. “Is the property values going to go down? Are there going to be construction vehicles everywhere? It’s just not why we moved here. The beauty, peace, and quiet bares around all of that,” In October, Texas-based Nacero announced it wants to build a $6 billion facility on 3000 acres of reclaimed coal mining land in Newport Township, near Nanticoke. The facility would turn natural gas into gasoline that can be used for vehicles. Nacero claims the gasoline would have zero sulfur admissions and 50 percent less CO-2 emissions. Around 4,000 construction jobs would be created and 500 high paying permanent jobs. The project is being touted as one of the biggest economic projects in the history of Luzerne County. “Residents are right to have some questions. We’re going to have a very public process. Nacero has been very open and transparent in the early stage of this process. We recognize it’s going to take several years before this project is up and running,” said Senator John Yudichak, 14th District. Newport Township officials say they too are gathering information about the proposal. “As of this date no permits have been pulled and no paperwork yet. That’s all we know,” said Joe Hillan, Newport Township Manager “We know absolutely nothing as if and when it’s going to come or have we do not know yet until we get paperwork stating that it will be here,” said John Vishnefski Newport Township Commissioner. Scott Cannon is an environmental activist who says his group, Action Together, is closely monitoring the Nacero project. Community hopes for bright future with regarding Nacero facility “Nobody knows what a plant like this is going to bring to the area and people need to start asking questions,” said Cannon. In October I asked the Chairman of Nacero, Tom Tureen, about residents’ concerns at that point in time about the safety of the facility. “We are very attuned to safety as we are to the environment. But today when we build something for example or tanks are self-extinguishing functions. If a fire starts it’s put out in 90 seconds,” said Tureen. Nacero has yet to file any paperwork such as permits with any federal, state, or local agencies such as the State Department of Environmental Protection, the D.E.P. We reached out to the company today and have not heard back. In October, Nacero says they hope to begin construction in two years. It would take four to six years to complete. Lou Barletta, R-Hazleton, deserves an award. On Tuesday, backed by Gas Drilling Awareness Coalition members, OMalley delivered a trophy inscribed Congressional Climate Denier Award: For exceptional extremism and ignoring the overwhelming judgment of science. A silver unicorn, front legs kicking, topped the trophy to represent what OMalley said is a fantastic belief that humans do not cause global warming. The drive-by award ceremony was inspired by the congressmans statement in 2010 that there is not enough evidence to prove man-made climate change one way or the other, according to a press release from OMalleys firm. Barletta was not in his office but, in a written statement, a spokeswoman said the congressman believes we must seek balance in environmental policy. While everyone wants a clean environment, restrictive policy has hampered the growth of industry, the statement said. In todays economic climate, we simply cant afford regulations that will destroy jobs, raise energy prices and increase our dependence on foreign sources of energy, the statement said. These kinds of awards are being given around the country this week to Congress members who question global warmings validity. Organizing for Action, a non-profit advocacy group that promotes President Barack Obamas policy pursuits, is credited for inventing the award. According to Organizing for Action, 97 percent of scientists accept climate change research. The federal Environmental Protection Agency reports that NASA and the National Oceanic and Atmospheric Administration agree that climate change is real and humans contribute to the rising global temperature. OMalley said politicians must recognize these facts and write laws to protect the environment. Future generations are going to be impacted by what we havent done, OMalley said. $Luzerne County Council Act 13 Presentations April 10, 2012 WILKES-BARRE - Luzerne County Council decided Tuesday to postpone a vote to adopt an ordinance that would give the county a share of natural gas revenue until after a state judge rules whether to temporarily stop it from taking effect. Act 13 allows counties and municipalities to receive impact fees from natural gas wells and related infrastructure, but it also lets gas companies challenge local ordinances that are stricter than state law. A Commonwealth Court judge will hear a request Wednesday morning for an immediate injunction filed by a group including seven municipalities that contends the law is unconstitutional because it takes away local ability to control land use. Several council members suggested waiting until after the judges ruling to vote on the ordinance. Council President Jim Bobeck reminded them that under the state law, theres an April 16 deadline for counties and municipalities to pass an ordinance or they wont get any money. The council agreed to a special meeting at 6 p.m. Monday as well as an amendment to the ordinance, which will now specify that its adoption does not limit Luzerne Countys right to challenge the validity of provisions of the act. Although council members unanimously dislike the legislation, they are divided on whether or not the county should benefit from it. Councilwoman Elaine Curry, who called it a poster child for bad legislation, said she is concerned from a health care standpoint. One provision in the law is that if a doctor has a patient who thinks he or she was exposed to any chemicals used in hydraulic fracturing, the doctor has to request in writing a list from the drilling company and sign a non-disclosure agreement, she said. Councilwoman Linda McClosky Houck said she believes the act will be repealed. But in the meantime, she said, if a driller comes to town and there is no ordinance in place, the county would miss out on the fee. Nine residents asked council to vote against the ordinance. Their main concern is that under Act 13, companies could put wells and gas infrastructure anywhere, including residential neighborhoods and near schools and water supplies. Its almost a bribe, as if you were coerced to take the money, because state government knows all local municipalities need money, said Dave Thomas of Plymouth Township. Kim Krupsha of Kingston spoke on behalf of her nieces and nephews, who attend the Dallas schools. She recalled how district residents and members of the Gas Drilling Awareness Coalition successfully worked to prevent Chief Gathering LLC from building a natural gas compressor station less than a third of a mile from the Dallas campus. Gas Drilling Awareness Coalition co-founder Dr. Thomas Jiunta pointed out that gas wells only have to be 1,000 feet from water supplies such as the Huntsville and Ceasetown reservoirs. Exeter councilman Larry Dellegrotto said borough officials spent a considerable amount of time, effort and money to redo the zoning ordinance to regulate where oil and gas related activity can go to protect residents.
