Tyler Robinson's defense has identified what could become a major problem for prosecutors trying to keep the death penalty on the table. The state argues that allegedly firing a high-powered rifle at Charlie Kirk while surrounded by thousands of people knowingly created a great risk of death to others. But Robinson's lawyers say Utah's capital aggravating factor is much narrower—and they argue prosecutors are now trying to rely on evidence and arguments they failed to properly establish during five days of testimony. If the judge agrees, the consequence could be enormous.
I break down the defense's “one shot” theory, the constitutional argument for narrowly interpreting death-penalty aggravators, and the fight over whether anyone other than Charlie Kirk was actually within the legally relevant zone of danger. I also explain why I think several defense arguments are weak. A single shot can create a deadly risk to multiple people, and many of the supposed examples of prosecution “speculation” look to me more like perfectly permissible inferences from actual evidence.
But remember what victory means for the defense at this stage. They don't have to win the entire case. If they can persuade the judge to strike this aggravating factor and remove the death penalty, then even a sentence of life without parole could represent an enormous legal victory for Tyler Robinson's lawyers.
