Does Germany have a duty to protect people from the consequences of its arms exports?
A Palestinian from Gaza is seeking clarification on this matter from the German Federal Constitutional Court. He is invoking his fundamental rights to life and effective legal protection.
After the Higher Administrative Court in Kassel recently rejected his request for urgent legal protection, the Constitutional Court now needs to examine whether the Kassel court’s ruling – namely, that those affected cannot take action against export licenses – is compatible with the German Basic Law.
