One year to the day after Malcolm-Jamal Warner drowned in Costa Rica, his widow filed a lawsuit β against his mother. π Tenisha Warner is suing Pamela Warner in DeKalb County Superior Court for at least $1,276,042, claiming the late Cosby Show star never honored the prenuptial agreement they signed in May 2022, about a week before their wedding.
According to the complaint, Malcolm allegedly agreed to maintain a $1 MILLION life insurance policy naming her sole beneficiary β which she says he never bought β plus $5,000 a month as his "chief of staff," $16,000 a year tax-free, a retirement account in her name, and college funds for their children. Court filings put his earnings around $680,000 a year and his net worth near $3.4 million at the time of his death.
But here's what most people are getting wrong: Tenisha isn't suing as an heir fighting over an inheritance. She's positioning herself as a CREDITOR. Her argument is that he signed a contract, died without honoring it, and debts get paid before anyone inherits. The catch? She says his estate is currently unrepresented and can't cover what she's owed β so she's reaching into the Warner Family Trust, which Malcolm established back in 1996 and which his mother now controls as successor trustee. That's why Pamela is the named defendant. Tenisha is also asking the court to freeze any distributions from that trust while the case plays out.
