If you fly drones you are probably familiar with some sort of Air Space map like B4UFLY aka Aloft formally known as Kittyhawk. These kinds of mobile applications are a great way to stay up to date with current FAA airspace restrictions for things like airports and NOTAMS whether you fly recreationally or as a part 107 commercial pilot.
If you use this app often you may have noticed more restrictions popping up all over the map. This is due to a new feature called Geo Portals added by the developers at Aloft. This feature allows verified users like a city or county government to add their own local laws and regulations to the map. I think this feature is great, it may just prevent you from getting a fine for flying where you are not supposed to.
But I have discovered that this information is not always correct, in fact, some of it is in direct conflict with federal law. I noticed several areas in a local county now claim you are not able to launch or land from their open space areas. This is totally legit and their legal right to prevent this activity on their lands. But they also state you are not allowed to fly your drone over their land.
According to the FAA local governments are not allowed to make rules related to the navigable air space above their property. If this was the case you would not be able to fly just about anywhere. I reached out to a county representative to get clarification and it appears they know they cannot restrict flights over their land.
So what is the answer to this problem that is surely going to confuse new and veteran pilots alike? Reaching out to the developer (ALOFT) and asking them to vet the information to better align with the law is the only way to fix this issue. I encourage you to search your local area and see if any of these user-added Geo Portals feature incorrect information and reach out to aloft about correcting it.
I think ALOFT is great and this is not a slam on their products and services. With a small tweak, this will be a powerful and hopefully accurate addition to the app.
