South Africa may be on the verge of a major shift in how land invasions and illegal occupation are handled. A new amendment to the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, commonly known as the PIE Act, has officially been gazetted for public comment, and it could have serious implications for property rights, municipalities, and land invaders.
In this episode of Newsflash, we break down the key proposals in the new PIE Amendment Bill and what they actually mean in practice. The Department of Human Settlements is proposing stricter measures to deal with illegal land occupation, including criminal penalties for individuals who incite or organize land invasions. This includes the possibility of fines up to R2 million or imprisonment for those found guilty of encouraging unlawful occupation.
Another major development is the introduction of asset forfeiture. This means that anyone who profits from illegal land occupation could be forced to give up money or assets gained through these activities. This directly targets so called “shack farming” and organized land invasion networks that have been operating in parts of South Africa.
The bill also expands the powers of municipalities, allowing them to act more decisively even if they are not the direct landowners. Courts will now have more discretion when it comes to eviction orders, including the ability to determine whether alternative accommodation must be provided, and for how long. This is a significant change from the current system, where the obligation to provide housing can delay evictions for extended periods.
Additionally, courts may now authorize the demolition of structures built during illegal occupation, something that has historically been restricted under the current PIE Act framework.
While these changes appear to strengthen property rights and improve enforcement, there are still serious concerns. Issues such as slow police response times, court backlogs, and the practical enforcement of these laws remain major obstacles. Even with stronger legislation, implementation will determine whether these reforms actually make a difference on the ground.
