Important documents go missing in families all the time, and it turns into a property dispute. Sometimes it happens to countries too.
Nepal claims Lipulekh, Kalapani and Limpiyadhura on the basis of the Treaty of Sugauli, signed in 1816 with the East India Company after the Anglo-Nepalese War. Nepal's reading is that the boundary runs from the point of origin of the Kali river, and everything east of it belongs to Nepal. India's position is that the treaty assigned the west-flowing course of the Kali โ today's Uttarakhand โ to British India, and that Nepal's claims are not supported by historical facts and evidence.
Then came the twist. Speaking in Nepal's House of Representatives, Foreign Minister Shisir Khanal said the government does not have confirmed information on whether the documents it holds are the official originals. Some treaty records sit in the National Archives, but officials have been unable to establish whether the signed original is among them.
And it is not only the Sugauli Treaty. A parliamentary inquiry that searched the Department of Archaeology, the Narayanhiti Palace Museum and the Ministries of Law and Foreign Affairs concluded that the originals of both the Sugauli Treaty and the 1950 Treaty of Peace and Friendship could not be traced. A similar search in 2019 also came up empty. The 1950 treaty is the one that governs the open border.
Pratik Nayak also connects this to the wider pattern:
- The Durand Line, drawn between British India and Afghanistan, now a live territorial issue between Pakistan and Afghanistan
- The McMahon Line and Aksai Chin, both products of British-era mapmaking, now central to the India-China boundary question
- The Susta dispute, a second unresolved India-Nepal issue
- Similar territorial questions with Bangladesh and Sri Lanka
Wherever the British drew lines, the neighbours inherited the arguments.
Why this should not define India-Nepal relations: an open border of roughly 1,800 km, citizens who live, work and travel freely across it, and the roti-beti ties that no map dispute has managed to touch.
