Judge Mark Gildea has issued a new discovery order in O’Keefe v. Read governing how deposition testimony and protected information may be used. In this video, I examine the order, the restrictions it creates, and why I believe it raises serious questions about the court’s handling of discovery in the Karen Read civil case.
I break down the filing line by line, including the court’s reference to information suggesting a possible impoundment violation, its restrictions on deposition material, the warning about possible sanctions, and the footnote allowing nonparty discovery—including the Michael Proctor deposition—to resume.
I also examine retired Massachusetts Judge Carol Erskine’s concerns about Judge Gildea’s language and the appearance of partiality. I compare those concerns with Rule 1.2 of the judicial-conduct code and explain why I believe this order must be challenged and Judge Gildea should no longer oversee this case.
