Speaking to Palestine Deep Dive, BDS co-founder Omar Barghouti argues that focusing solely on banning goods from illegal Israeli settlements misses a fundamental point: “This is the first case in history where governments are calling for punishing the crime, not the criminal.”
Barghouti argues that the responsibility lies with the Israeli state itself, pointing to the International Court of Justice’s 2024 advisory opinion, which found Israel’s continued presence in the occupied Palestinian territory unlawful. This means governments continuing to enable Israel through trade, diplomacy, finance, academia and culture must also be held accountable, he explains.
While the ICJ ruling is significant, Barghouti stresses that courts cannot enforce their decisions alone. “We are the enforcement,” he says, arguing that only “power from below” and broad grassroots coalitions can translate international law into real political change.
