The Brian Walshe jury has been deliberating for hours without a verdict, and that has surprised many observers.
This is a legally difficult case. Without a body, the Commonwealth must still prove beyond a reasonable doubt that Brian Walshe caused Ana Walshe’s death, intended it, and premeditated it — even if only for seconds.
In this video, I break down why these issues are so hard in this case, how both sides addressed those problems in closing arguments, and what the judge’s instructions mean for the jury.
On New Year’s Day 2023, Ana Walshe vanished without a trace—leaving behind three young sons. Hours later, police say her husband Brian Walshe was googling how to dispose of a body. Police say they found blood in the basement and in a trash container miles from the Walshe home. But they have never found the body of Ana Walshe. Now Brian Walshe is going on trial for the murder of Ana.
