So time in time again, I keep seeing individuals that are misinformed about the legality in transmitting without a proper licence for the Baofeng radio.
The common misconception here is that those with a GMRS licence can legally use the baofeng radio for both GMRS and FRS purposes.
This is an inaccurate statement, but I think it's important that we understand why this is.
Without a Amateur Radio Licence, and if there is no danger to life, the Baofeng radio is absolutely illegal to use.
This is because the baofeng radios are Part 90 Certified, but not 95E or 95A, which is a requirement for GMRS.
We should explain why this is the cause, and be sure to help people understand that there is no exceptions to the above rule.
I'm not trying to police people, but I just keep seeing the same comments being made everywhere, so I made this video that I can link to those, and explain why they are incorrect.
