A federal judge paused the $81 billion merger of Paramount and Warner Bros. Discovery. This may not have been necessary if the Department of Justice (DOJ) had taken its corporate enforcement mandate more seriously. But under this administration, a proven method has emerged to keep the government out of your business: make it personally profitable for Donald Trump. Former U.S. Department of Justice Pardon Attorney Liz Oyer (@Lawyer_Oyer) is surprised there was even an intervention at all.
“The Justice Department has essentially abdicated its role for enforcing the antitrust laws, which is why state attorney generals are having to step in and bring these lawsuits. And courts are exactly, as you said, playing the role that the Justice Department generally would play because they really don’t believe in corporate law enforcement.”
