This is an updated tutorial on How to Complete the W-8BEN Form. Even though it was updated in October 2024, it is the same form that applies in 2026. The W-8BEN form is a legal document called the “Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding”. If you earn US income and you live outside the US, you can avoid paying US taxes or pay a reduced US tax rate.
The W-8BEN form allows you to avoid double taxation. If you are an individual, you should complete the W-8BEN form; and if you are a business entity, you should complete the W-8BEN-E form. Essentially, the W-8BEN form is required to be completed by foreign nationals to US tax authorities to declare your tax status to the IRS.
The form has three main parts: (1) IDENTIFICATION OF BENEFICIAL OWNER; (2) CLAIM OF TAX TREATY BENEFITS; (3) CERTIFICATION. The purpose of completing the W-8BEN-E form is so that individuals or companies, in the US, from whom you earn income from, will not withhold tax from you.
You don’t need to send this to the IRS you only need to provide it to the individual or company (in the US) from whom you are receiving income.
