Free speech was promised in 1791. So why did it take until the 1930s for American courts to actually protect it?
For the first century of American history, judges agreed the First Amendment only stopped the government from censoring you before publication. Afterward, you could still be punished. Courts relied on the "bad tendency" doctrine: if your words might lead to something socially undesirable, that was enough. Radicals, socialists, labor organizers, and war critics found out what that meant.
Drawing on legal historians Jud Campbell and David Rabban, this video traces how the modern First Amendment was actually built — not by the Founders, but slowly, in dissenting opinions from Holmes and Brandeis, and an older tradition running back through Mill and Milton.
The same temptation keeps returning: let someone powerful decide which ideas are too dangerous to circulate.
