In this episode of The Indian Express, Sayoni Aiyar examines the controversial personal insolvency case of Essel Group founder Subhash Chandra, after the National Company Law Tribunal (NCLT) approved a repayment plan that offers creditors a recovery of a tiny fraction of the liabilities linked to his personal guarantees.

The decision has triggered strong objections from lenders, with HDFC Bank exploring an appeal before the NCLAT and LIC Housing Finance highlighting its recovery of just ₹38.09 lakh against an exposure of ₹1,322.39 crore.

At the heart of the controversy is a fundamental question: How much is a promoter's personal guarantee actually worth when the promised wealth isn't legally available to creditors?

The case also raises questions over the voting process, the role of promoter-linked entities, Section 79 of the Insolvency and Bankruptcy Code, and whether corporate structures can create loopholes around related-party voting restrictions.
