In This weeks Radio Dork news A U.S. District Court judge has denied a motion by the FCC to dismiss a case challenging the FCC's denial of an amateur radio license application to a reddit user that goes by the name "CaptKirk2021". The ruling, issued by Washington DC District Court Judge Ana C. Reyes, marks a key early victory in the case challenging FCC character qualification reviews for amateur radio licenses.
The suit, initially filed in October of 2024, alleges that the FCC is attempting to deny the plaintiff's Amateur Radio license application without providing an evidentiary hearing, which the plaintiff, CaptKirk2021, claims is required under the Administrative Procedure Act of 1946, as well as the FCC's own stated Character Policy. Ham radio CW signals, also known as Morse Code, have been found to interfere with certain transponders on Boeing 787 Dreamliners, contributing to an $8 million dollar repair bill for several airlines, including American, United, and Alaska Air. As reported by the PaddleYourOwnKanoo..com website, the issue was discovered after the FAA received reports of Mode-S transponders no longer replying to radar interrogations, resulting in the jetliners becoming invisible to air-traffic controllers, which could lead to a mid-air collision, or worse.
