Josue David Pineda Munoz, 20, is facing felony terroristic threat charges after authorities say he repeatedly threatened ICE officers.
According to court documents, the incident happened at about 3 p.m. on June 28 outside the Homeland Security Investigations in the 1000 block of Jackson Keller Road. Four ICE officers were completing fugitive-apprehension operations and unloading law enforcement equipment when a red 2017 Honda CR-V drove through the area. Investigators said an object was thrown from the vehicle toward the officers. The object was later determined to be a clear plastic water bottle.
The Honda then made a U-turn and approached the officers again, according to the affidavit. As the vehicle approached, the driver allegedly held a dark-colored or black object toward the officers. Because of the way the object was displayed, officers initially believed it could be a weapon and that they faced an immediate threat of gunfire. Officers sought cover and drew their agency-issued firearms.
The driver passed the officers several more times. During one pass, officers said they saw the driver holding a cellphone toward them and heard him yell profanities and the words, “I’ll shoot you.”
Investigators said the Honda made another U-turn and drove past the officers for a fifth time before leaving the area. Officers obtained the vehicle's license plate but did not conduct a traffic stop or detain the driver at the scene.
Investigators later traced the Honda to its registered owner and used surveillance, driver's license information and social media photographs to identify Pineda Munoz as the suspected driver. Two of the officers later identified him from photographs as the person they saw driving the Honda.
Investigators say Pineda Munoz's actions caused the officers to redirect their attention from the fugitive operation, take cover and draw their weapons. Authorities allege his actions placed the officers in fear of imminent serious bodily injury and disrupted the activities of a federal government agency.
Pineda Munoz is charged with terroristic threat, a third-degree felony.
