Did C.H. Robinson make a massive mistake by taking its broker liability fight all the way to the Supreme Court?

Matthew Leffler explains why C.H. Robinson supported Supreme Court review of the Montgomery case and why, despite ultimately losing unanimously, pursuing the case may still have been the right move.

With the U.S. Chamber of Commerce, FMCSA, Department of Transportation and Department of Justice supporting C.H. Robinson’s position, Leffler says there were plenty of reasons to believe the company could win. But the bigger issue for freight brokers is consistency.

Different federal circuits have treated broker liability differently for years. Win or lose, Leffler argues the industry needs a nationwide standard so every broker operates under the same rules.
