After a man’s vehicle broke down on a busy highway, an approaching tractor-trailer swerved to the shoulder of the road and easily avoided a collision. However, a second approaching vehicle made no attempt to avoid the hazard and plowed through the disabled vehicle, causing a fiery explosion that killed the driver.
Matt Kyle, Esq., and Fred Cludius, Esq., needed to show how the Defendant truck driver could have easily avoided this collision had he noticed the Plaintiff’s flashing hazard lights and swerved around the immobilized vehicle like the first truck driver.
We created an accurate animation series that would achieve the following objectives.
1) Establish what happened from an aerial perspective.
2) Show what happened from the Defendant truck driver’s perspective.
3) Demonstrate how easily this collision could have been avoided, from the Defendant truck driver’s perspective, had he simply recognized the flashing hazard lights and swerved around the Plaintiff like the first truck driver.
4) Anchor the audience’s understanding of the impact this negligence caused for the victim by recreating the scene from the perspective of a theoretical witness to the violent collision up close.
5) Reinforce the accuracy of the animation series by displaying it alongside a split-screen of real-world footage we captured during the on-site inspection.
To ensure the accuracy and admissibility of our animations, we traveled to the scene to perform a full on-site inspection of the roadway architecture, vehicle models, and nighttime visibility. Collision Recon experts simulated the motion data and headlight measurements were calculated through photometric testing.
The following animation series helped the Plaintiff’s legal team show how the Defendant could have easily avoided this disaster and was undeniably liable for the Plaintiff’s death. Mr. Kyle and Mr. Cludius were able to negotiate a successful, confidential settlement for their client.
