THE SIXTH (6) AMENDMENT (In all criminal prosecutions, the accused shall enjoy the right to a speedy
and public trial, by an impartial jury of the State and district wherein the crime shall have been
committed; which district shall have been previously ascertained by law, and to be informed of the nature
and cause of the accusation; to be confronted with the witnesses against him; to have compulsory

evidence while they are investigating possible criminal activity, And evidence obtained through illegal

EXHIBIT H - The Void-For-Vagueness Doctrine
(By requiring fair notice of what is punishable and what is not, vagueness doctrine also helps prevent
arbitrary enforcement of the laws. A vague criminal statute is unconstitutional for violating the 6th
Amendment. Rests on the DO PROCESS clauses of the Fifth and Fourteenth Amendments of the U.S.
Constitution. Requiring that a penal statute define a criminal offense with sufficient definiteness that
ordinary people can understand what conduct is prohibited and in a manner does not encourage
arbitrary and discriminatory enforcement) NOTE: Under the void-for-vagueness doctrine, a vague law is
a violation of due process because the law does not provide fair warning of a prohibition. A constitutional
rule that requires criminal laws to state explicitly and definitely what conduct is punishable. Any
prosecution which is based upon a vague statute must fail together with the statute itself. Criminal laws
that violate this requirement are said to be Void of Vagueness.)

TRUTH-IN-EVIDENCE, EVIDENCE CODE SECTIONS 780 AND 1103 (For a crime to exist, there must
be an injured party (Corpus Delicti) There can be no sanction or penalty imposed on one because of this
Constitutional right.) Sherer v. Cullen 481 F. 945 (With no injured party, a complaint is invalid on its
face”. Gibson v. Boyle, 139 Ariz. 512) Supreme courts ruled “Without Corpus delicti there can be
no crime” “In every prosecution for crime it is necessary to establish the “corpus delicti”, i.e., the
