Gas facility arguments conclude
Dallas Twp. zoning hearing board will decide on Chief Gathering application Dec. 7.

DALLAS TWP. -- The final witness testified and closing arguments were presented Tuesday at a zoning hearing for Chief Gathering LLC's application to build a natural gas metering station off Hildebrandt Road.

Sonia Maslowski, of Fairground Road, said she had concerns about worksite safety, property devaluation, traffic and the effect an influx of workers from outside the area would have on her family and property located about 600 feet from the proposed site.
Maslowski said her residence is the closest in proximity to the site, a fact that she felt Chief's paid expert witnesses "may have elected to ignore."
She said the only safe option is to move the site to an area where there are fewer residences and no schools.
Chief's application for a special exception outlines the details of a metering station that would be about 1,300 feet from the Dallas School District campus.
The meter would measure gas flowing through a not-yet-built Chief pipeline that will tap into the Transco interstate pipeline that runs through the township.
Attorney Mark McNealis, who represents the Maslowski and Dottor families, said in his closing arguments the application doesn't apply to the criteria for special exceptions because he felt the type of activity was already addressed in the zoning ordinance.
He said the metering station would fit into the definition of heavy industrial use, which would deem the activity be moved to an industrial zone. Chief's facility would be in an agricultural zone.
Attorney Tim Kelly, who represents the Dallas Parents-Taxpayer Group composed of several citizens, agreed with McNealis and also said the activity is hazardous to the community and the health of its citizens.
Chief attorney Ken Komoroski said that while Chief has taken part in the proceedings under protest, the company has tried to address all concerns raised, especially safety issues. He said the company heard from opposing witnesses who "mischaracterized testimony" and "misstated facts as presented," and he hoped the board would not be "swayed or deterred" by those witnesses in its decision.
