Our current city code 14-417(C) states: "It shall be illegal to engage in camping on any public right of way or public property located within the area of the city zoned CD as defined by Chapter 20 of this code, unless there is no overnight shelter available to the person camping therein and such person remains on public property."

Simply put, Lawrence has more homeless outside than bedspace inside, and has for a long long time. Trespassing Enforcement of City owned 'CD' zoned land can't happen without more available shelter or a change in the city ordinance. To do otherwise would pit Lawrence against caselaw in the 9th Circuit that is being taken up by the Supreme Court this year (Grants Pass v Johnson).
