Newly disclosed evidence is complicating Karmelo Anthony’s attempt to overturn his murder conviction.
During a hearing over Anthony’s request for a new trial, First Assistant District Attorney Bill Wirskye said Anthony’s cellphone contained a message about stabbing someone and another message sent the morning Austin Metcalf was killed stating that Anthony was “on the verge.”
The jury never heard those messages. Prosecutors and the defense had agreed to keep potentially inflammatory character evidence about both teenagers out of the trial. Anthony’s former attorney now argues that a dispute over that agreement prevented Anthony from testifying about his self-defense claim.
Judge Michael Chitty must decide whether the disputed agreement, courtroom-access restrictions, or jury instructions denied Anthony a fair trial.
The same evidence that may damage Anthony publicly could now become part of the argument for giving him an entirely new trial.
