Below you will find a video that was taken in our police department this afternoon. It deals with the procedures of filing a criminal complaint against one of our officers. This same person visited our department in March of last year, and brought to the forefront the problems with our procedures for filing a complaint. In an attempt to correct any issues, I sent out a memo with procedures on assisting citizens that wish to lodge a complaint. Obviously I did not get the information out well enough. The attached video will be used as a training tool for our department and other city staff on how NOT to handle those that want to file a complaint on one of our officers. This video gives the impression that this department has something to hide. Such is not the case. If that were true, I would not be posting this on our Facebook page not to mention the Administrative Complaint packet can be found on the City of Balcones Heights web page at:

Article 6252-20 of the Vernon Texas Civil Statutes (V.T.C.S.) requires only the complaint be in writing and signed, as is mentioned at the top of the first page of our Administrative Complaint Packet. The first page is called a “Statement Information Supplement (SIS)”. If we have additional questions about the complaint or the District Attorney needs to contact you about a possible criminal matter that your complaint may have turned in to, your contact information will be readily accessible. Without this information, the complaint may be dismissed due to the inability to re-contact the witness to obtain further pertinent information. As for the second and third page asking for a statement to be notarized, statements involved in a criminal case are notarized for trial should there be a trial. This is not meant to intimidate but rater accommodate the individual making the complaint. There will be no need to call the complainant back in at a later time to take a sworn statement. Included in this “SIS” is the notice of the definition and offense classification for Aggravated Perjury. This is not meant to intimidate either. Several days ago our complaint packet was brought to our attention as being in need of revision and we have responded. In reviewing our documents it was obvious they were in need of updating. It was never our intent, nor will it ever be, to intimidate those that turn to us for assistance. After hearing from everyone it became apparent our form could be considered intimidating to some. With that being said, I sat with our City Administrator along with soliciting the assistance of or City Attorney to visit our old form and make any changes that were necessary to make it less intimidating yet continued to meet the requirements of Texas Law. As previously mentioned, these forms are available immediately on line and by the end of business Monday (02-13-2017), these forms will be available in print version located on the first and second floors of the Justice Center located at 3300 Hillcrest Dr., Balcones Heights, TX. 78201.

In closing, constructive criticism is always appreciated. We strive to make this police department the best that it can be. That being said, messages and comments (posts) that have no real value other than someone just blowing off steam will not be responded to. If we are here to give you a place to vent, as long as it meets our "Terms of Use" policy located in our notes section, then we are doing our job.
