We’ll explore a broader constitutional question: whether the 12th Amendment, which created the modern system of separate ballots for President and Vice President, should itself be revisited. The original Constitution allowed electors to cast two undifferentiated votes, with the runner-up becoming Vice President. The rise of political parties made that system unworkable, leading to the 12th Amendment in 1804. But did that fix create new problems of its own?
