Originality, similarity and likelihood of confusion.
Originality is the foundation behind every element deserving protection, and we believe that many of the models which GW are accusing us of counterfeiting are lacking originality, creativeness and distinctiveness to grant them exclusivity of selling models of that idea.
GW targeted almost every model in our catalogue, including orcs, generic skeletons and ww2 inspired soldiers. We believe they do not own protective rights on these generic ideas.
Are GHAMAK models so similar to GW models to be considered slavish imitation? As you can see from the examples in the video, there are as many differences between GHAMAK and GW models as there are between GW models and real-life examples or prior art.
Are GHAMAK models so similar to GW's that a customer would think they are from GW?
If you believe in creative freedom and want us to take it all the way in court, we need your support. Please share this video and donate what you can, so we can afford the legal fees.
