MONTGOMERY, Ala. -- The Alabama Court of Criminal Appeals has overturned the case of a man sentenced to die in the murder of his infant son in Franklin County in 2005.
The court ruled today that Jodey Wayne Waldrop should receive a new trial in the killing of Jodey Chance Waldrop. The boy was 3 weeks old when he suffered fatal brain injuries from being violently shaken.
Jurors heard testimony during the trial about a previous conviction Waldrop had for assault, but the judge failed to instruct them on how to consider that evidence.
The Criminal Appeals judges said jurors could have considered that previous case to be evidence that Waldrop killed his son, so they overturned the conviction and sent the case back to Franklin County.
