Lee Gilley is charged with murdering his wife Christa, who was 9 weeks pregnant at the time of her death.
Lee Gilley was allowed out on bond pending trial. But less than a month before trial, he fled the country using a false name and a fake Belgian passport. He went through Canada to Milan, Italy, where he was taken into custody. Lee Gilley argues he should not be returned to the U.S. until prosecutors agree not to impose the death penalty.
Fleeing the country carries significant downside for Gilley, because the prosecution likely will argue it shows “consciousness of guilt.”
The case sits in legal limbo right now, as the two countries figure out what to do.
