Armed Attorneys Richard Hayes and Edwin Walker discuss a major Second Amendment victory for veterans after the VA announced it will stop reporting veterans to NICS solely for needing a fiduciary to manage VA benefits.
For decades, veterans in the VA Fiduciary Program were reported to the FBI’s National Instant Criminal Background Check System (NICS) as “prohibited persons” — without a court hearing, without a judge, and without any finding that they were a danger to themselves or others.
This was an internal administrative process — not a judicial determination — yet it resulted in the loss of Second Amendment rights.
We reported on this issue over two years ago. Now the VA acknowledges the practice violated both federal law and veterans’ constitutional rights.
